Terms and Conditions applicable for use of
www.miragesearch.com are as under:Mirage Search service provider for promotion of
information and exchange among its users. As in any other service, there are certain rules and laws that you should
understand and that you are required to adhere to. Mirage Hosting owns the product of Mirage Search.General Release:- Mirage Search is not involved in
the actual transaction between buyers and sellers. You are cautioned that there are risks in dealing with people you do not
know, and that Mirage Search has no control over such risks. We have no control over the quality, safety, or legality of
items advertised the truth or accuracy of the listings, the ability of sellers to actually sell items they list, or the
ability of buyers to actually buy items.
- As we are not involved in the
transactions between you and other users, you hereby release Mirage Search and its agents, affiliates and employees, from all
refunds or warranties, claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown,
suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with listings, completed or
incomplete transactions, or items offered or actually sold.
- You are advised that
you must be at least 18 years of age and possess other legal authority to enter into this agreement and to use the Services
in accordance with all terms and conditions contained herein. While buying or selling goods using this Service, you further
warrant that you have legal authority to enter into other binding & selling agreements for the sale or purchase of goods.
You agree to be financially responsible for all of your use of the Services (as well as for use of your account by others,
including without limitation minors living with you). You also warrant that all information supplied by you or members of
your business and/or household in using the Services, including without limitation your name, e-mail address, street address,
telephone number, credit card number (when required), and if you are selling goods, all information about your listed goods,
is true and accurate.
- You warrant that you will abide by all such additional
procedures and guidelines, as modified from time to time, in connection with your use of the Services. You further warrant
that you will comply with all applicable laws and regulations regarding use of the Services. Without limitation, by listing
an item for sale, you warrant that you have the legal right to sell the item.
- As
a seller, you agree to accurately describe the items you are selling and list your items in the right
category.
- Mirage Search reserves the right to cancel any listing at any time, and
reserves the right to prohibit or restrict access to the Services to anyone at any time, with or without assigning any
reason. Mirage Search reserves the right of removing the profiles of people who register with bogus contact information be
they addresses, telephones or other information. Mirage Search reserves the right of removing the web mail of people who get
involved in using web mail for Nigerian frauds.
- As a user of Mirage Search, you
agree that users may comment on their experiences with you in the feedback section of Mirage Search and you release Mirage
Search and its users from any liability for any comments.
- It is your
responsibility to determine
whether the purchase or sale of any listed item is authorized by law,
statute, or regulation. Without limitation, the following items may not
be sold or offered for sale on the Mirage Search market places:
- Firearms, explosives, and ammunition;
- Alcoholic beverages (except
if you are reselling an alcoholic beverage that was initially purchased from a retailer and is still in its original
container and it is legal to deliver into the jurisdiction where the buyer lives);
- Tobacco products;
- Food that is not packaged or does not comply
with all applicable laws for sale to consumers by commercial merchants;
- Pharmaceutical and controlled substances;
- Counterfeit, pirated or
stolen goods;
- All or any goods that infringe or otherwise violate another party
rights, including copyright, patent, trademark, and rights of publicity and privacy;
- Goods that are, in Mirage Search discretion, indecent, obscene or pornographic;
- Registered or unregistered securities;
- Goods which you do not have
the legal right to sell;
- Goods which are misrepresented or which do not in fact
exist;
- Goods which, if sold via the Services, would cause Mirage Search to
violate any law, statute or regulation.
PasswordYou cannot use your password for any unauthorized purposes. You are solely responsible for actions
taken under your password, and should not disclose it to anyone else. Compliance With LawsYou agree to be bound to comply with all applicable laws, statutes, ordinances and regulations concerning your
participation in Mirage Search services.Others
InformationYou hereby agree not to make use of anyone else's information
concerning Mirage Search market places other than as necessary to participate in Mirage Search and to complete any
transactions in which you are involved.Data OwnershipWhen participating in any Mirage Search service you may provide us with information about yourself
and/or your products and services. By this you also grant Mirage Search exclusive rights in all of this information, and all
information derived or generated from it, in all existing or future media. These rights include but are not limited to the
right to display your information anywhere on Mirage Search services and media properties, to search the information, and,
consistent with our privacy policy, to repackage and resell it to anyone for any reason. In this paragraph, information
includes but is not limited to data, text, photographs, drawings, sound recordings, feedback, and any other information or
data displayed or presented in connection with your listings on Mirage Search.Rights to Terminate
It is agreed by you that Mirage Search,
in its sole discretion, may terminate any use of the service or delete the listing immediately and without prior
notice.Agency
This agreement
does not create any agency, partnership, joint venture, employee and employer or franchisor and franchisee relationship
between Mirage Search and any user of the Service.False
InformationMirage Search reserves the right to terminate your account if at
any point of time www.miragesearch.com finds that the information provided by you in your registration or web mail is
false.
Lawsuit
These
terms and conditions and the relationship between the User and Mirage Search Service shall be governed by the laws of the
National Capital Territory of Delhi without regard to its conflict of law provisions. The User and www.miragesearch.com agree
to submit to the personal and exclusive jurisdiction of the courts located within the National Capital Territory of Delhi,
India
The AgreementIt is hereby
agreed by the user, despite any statute or law to the contrary, any claim or cause of action arising out of or related to the
use of Mirage Search service or the aforesaid terms and conditions must be filed within one (1) year after any such claim or
cause of action shall arise or be forever barred.
